This step is applicable to the case of projects located in one (01) district, town or provincial city. In this case, decision on approval for land acquisition plan shall be issued after the provincial People's Committee issues decision on land acquisition and land lease (refer to Art. 31.2.b of Decree No. 69/2009/ND-CP, Art. 32 of Circular No. 14/2009/TT-BTNMT). Particularly:
Within 05 working days upon issuing decision on land acquisition and land lease, the district People's Committee shall issue a decision on approval of land acquisition and compensation plan. Division of Natural Resources and Environment of district shall notify investor of such decision and ask investor to receive it at the division. Based upon this decision, investor shall pay compensation/support amounts to land users.
Within 03 working days as from the date of receipt of the approved plan on land acquistion and compensation, Compensation Council is obliged to coordinate with commune People's Committee to delare amd post it publicly at the head office of the commune People's Committee and at a place for community activities of the residential area where exists the to-be-recovered land.
At the same time, Compensation Council shall sent a decision on compensation, support and resettlement to land users having to-be-recovered land which clearly indicate amounts for compensation and support, arrangement of substitute house or land (if any) for resettlement, time and venue of a meeting for paying compensation and support and deadline for handing over the recovered land plots.
The decision on approval for land acquisition plan shall be sent to investor via post or received by investor at the date of payment. Thus, this step is optional.
